§ 01About these Terms

The Site is operated by the Optimus Gen 3 team (“we”, “us”, “our”). You can contact us at [email protected].

These Terms cover the Site and reservation requests only. The actual purchase of any Optimus Gen 3 unit is governed by a separate written purchase agreement, which will prevail over these Terms if there is any conflict.

§ 02Eligibility

You must be at least 18 years old and able to form a binding contract to use the Site or submit a reservation request. If you act on behalf of an organization, you confirm that you are authorized to do so and that these Terms bind that organization.

§ 03Reservation requests

• Submitting the reservation form is a non-binding expression of interest. It does not create a contract of sale, and no payment is taken on the Site.
• After you submit a request, we may contact you to confirm your details and invite you to place a refundable deposit through a secure invoice. Deposits are governed by our Reservation & Refund Policy.
• We may decline or cancel a reservation request at our discretion, for example if information is incomplete or inaccurate, if we cannot deliver to your region, or where required by law or export controls.
• Your place in the reservation queue is based on the date and time your deposit is confirmed, not the date the form was submitted.

§ 04Product information and pricing

We work hard to describe Optimus Gen 3 accurately. However, the product is in active development: specifications, features, images, configurations, availability, delivery estimates and prices shown on the Site are indicative and may change before a purchase agreement is signed.

Prices are shown in US dollars and exclude taxes, customs duties, shipping, installation and site preparation unless stated otherwise. Final pricing is confirmed in your purchase agreement. Images on the Site are illustrative and may not show the exact production design.

§ 05Acceptable use

When using the Site, you agree not to:

• submit false, misleading or third-party information without authorization;
• use the Site for any unlawful, fraudulent or harmful purpose;
• attempt to gain unauthorized access to the Site, its servers or related systems, or interfere with its operation;
• use bots, scrapers or automated means to access the Site or submit forms, except for standard search-engine indexing;
• introduce malware or any code designed to disrupt or damage systems.

§ 06Intellectual property

The Site and its content — including text, graphics, logos, drawings, design, software and the “Optimus Gen 3” name and marks as used on the Site — are owned by us or our licensors and are protected by intellectual property laws. Photographs are used under license from their respective creators.

You may view and print pages for your personal or internal business evaluation. You may not copy, modify, distribute, sell or create derivative works from the Site's content without our prior written permission.

§ 07Feedback

If you send us ideas or suggestions about our products or the Site, you grant us a free, perpetual, worldwide right to use them without obligation to you.

§ 08Third-party links and services

The Site may link to or rely on third-party websites and services (for example font or script delivery networks). We are not responsible for their content, policies or availability, and your use of them is at your own risk.

§ 09Disclaimers

To the fullest extent permitted by law, the Site and its content are provided “as is” and “as available”, without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement. We do not guarantee that the Site will be uninterrupted, error-free or free of harmful components.

Product warranties, if any, are provided only in your purchase agreement. See also our Disclaimer.

§ 10Limitation of liability

To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential or punitive damages, or for loss of profits, revenue, data or goodwill, arising out of or related to your use of the Site or any reservation request. Our total liability for any claim relating to the Site will not exceed the greater of (a) the amount of any deposit you paid to us, or (b) USD 100.

Nothing in these Terms limits liability that cannot be limited under applicable law, including liability for death or personal injury caused by negligence, fraud, or your statutory rights as a consumer.

§ 11Indemnity

You agree to indemnify and hold us harmless from claims, losses and expenses (including reasonable legal fees) arising from your breach of these Terms or your misuse of the Site, to the extent permitted by law.

§ 12Governing law and disputes

These Terms are governed by the laws applicable in the jurisdiction in which the operator of the Site is established, without regard to conflict-of-law rules. If you are a consumer, you also benefit from any mandatory protections of the law of the country where you live, and you may bring proceedings in your local courts.

Before starting any formal proceedings, please contact [email protected] so we can try to resolve the issue informally within 30 days.

§ 13Changes and contact

We may update these Terms from time to time. The “Last updated” date shows the latest version, and changes apply from the time they are posted. If any provision is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver.
